1. Agreement to Terms

By accessing or using MyPublicist ("Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by TenElevenTwelve LLC, a Texas limited liability company ("Company," "we," "us," or "our").

If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

MyPublicist is an AI-powered platform that helps users discover podcasts, generate personalized pitch emails, and manage podcast outreach campaigns. The Service uses artificial intelligence to analyze podcasts and create customized communication.

3. Account Registration and Security

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription and Payment

4.1 Subscription Plans

We offer tiered subscription plans (Starter, Growth, Pro) with varying features and usage limits. All fees are in US dollars and are non-refundable except as required by law.

4.2 Free Trial

The Starter plan includes a 30-day free trial. A valid payment method is required at signup. You will be automatically charged at the end of the trial period unless you cancel before the trial ends.

4.3 Billing

Subscriptions are billed monthly or annually in advance. Payment is processed through Stripe. By providing payment information, you authorize us to charge the applicable fees to your payment method.

4.4 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds will be provided for partial months or unused portions of your subscription, except as required by applicable law.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Send spam, unsolicited commercial communications, or deceptive content
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit viruses, malware, or harmful code
  • Harass, threaten, or abuse others
  • Impersonate any person or entity
  • Scrape, harvest, or collect user information without authorization
  • Attempt to gain unauthorized access to the Service or related systems
  • Use the Service in any way that could damage, disable, or impair the Service

We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy.

6. AI-Generated Content

The Service uses AI to generate pitch emails and analyze podcasts. While we strive for accuracy:

  • AI-generated content may contain errors or inaccuracies
  • You are responsible for reviewing all content before sending
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content
  • You retain ownership of your input data and any content you create

7. Intellectual Property

7.1 Our IP

The Service, including all software, designs, text, graphics, and other content, is owned by TenElevenTwelve LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7.2 Your Content

You retain ownership of all content you submit to the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display Your Content solely to provide and improve the Service.

8. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Anthropic Claude (AI), Resend (email), and Railway (hosting). Your use of these services is subject to their respective terms. We are not responsible for third-party services or content.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENELEVENTWELVE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless TenElevenTwelve LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (including payment obligations, disclaimers, and limitations of liability) will survive.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Texas.
