1. Agreement to Terms

By accessing or using MyPublicist ("Service"), operated by TEN ELEVEN TWELVE LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

MyPublicist is an AI-powered platform that helps solopreneurs discover podcasts, write personalized pitches, and manage podcast outreach campaigns. The Service uses artificial intelligence to analyze your expertise and match you with relevant podcast opportunities.

3. User Accounts

To use the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Notifying us immediately of any unauthorized use

4. Subscription and Payment

The Service is offered on a subscription basis with three tiers: Starter, Growth, and Pro. Payment processing is handled securely by Stripe. Subscriptions automatically renew unless cancelled. Refund policies are detailed in your subscription agreement.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Send spam or unsolicited messages through the Service
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service to harass, abuse, or harm others
• Reverse engineer or attempt to extract source code from the Service

6. Intellectual Property

The Service and its original content, features, and functionality are owned by TEN ELEVEN TWELVE LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of content you create using the Service.

7. AI-Generated Content

The Service uses AI to generate podcast pitches and recommendations. While we strive for accuracy and quality, AI-generated content should be reviewed before use. You are responsible for all content sent through the Service, including AI-generated pitches.

8. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Anthropic Claude (AI), Perplexity (search), Resend (email), Railway (hosting), and MongoDB (database). Your use of these services is subject to their respective terms of service.

9. Termination

We may terminate or suspend your account at any time for violations of these Terms. Upon termination, your right to use the Service will immediately cease. You may cancel your subscription at any time through your account settings.

10. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Governing Law

These Terms are governed by the laws of Texas, USA, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Texas.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email. Continued use of the Service after changes constitutes acceptance of the new Terms.
